1) Acceptance of these Terms

By accessing or using the Site, you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Site. We may update these Terms at any time by posting a revised version on this page; your continued use constitutes acceptance.

2) Purpose of the Site (Informational Only)

The Site describes and promotes remote-sensing/GIS consulting services, showcases representative case studies and research, publishes educational blog content, and provides ways to inquire, request proposals, and schedule consultations. Materials are general information and not professional advice, guarantees of outcome, or commitments to perform services. Viewing or contacting us through the Site does not create a consultant–client relationship; any engagement arises only under a separate written agreement (e.g., Proposal/Statement of Work or Master Services Agreement).

3) Changes, Availability, and Errors

We may modify, suspend, or discontinue any part of the Site at any time without notice. We strive for accuracy, but the Site may contain errors or omissions; we do not warrant completeness or timeliness.

4) Intellectual Property

All content on the Site—including text, graphics, logos, icons, images, maps, figures, code snippets, and layouts—is owned by us or our licensors and is protected by copyright, trademark, and other laws. Except as allowed by law (e.g., fair use), you may not copy, reproduce, distribute, modify, mirror, frame, scrape, or create derivative works without our prior written consent.

  • You may link to public pages in a way that is fair and legal and does not harm our reputation or suggest association, approval, or endorsement where none exists.

  • Third-party names, datasets, and tools (e.g., Google Earth Engine, ArcGIS Pro, Landsat, Sentinel) may be trademarks of their respective owners; no endorsement is implied.

5) Acceptable Use

You agree not to:

  • access the Site by automated means (bots, scrapers) except for public search-engine indexing;

  • upload or transmit malware, attempts to gain unauthorized access, or activity that disrupts the Site;

  • use the Site for any unlawful purpose, infringement, or violation of privacy or publicity rights;

  • misrepresent your identity or affiliation.

We may suspend or block access for suspected violations.

6) User Submissions; Feedback

If you submit information via forms or email (e.g., project inquiries, messages, attachments, or comments), you represent that you have the right to share it and that it is accurate and lawful. Do not submit confidential or sensitive information through the Site; confidentiality applies only if we sign a separate NDA or engagement agreement.

If you provide feedback or suggestions, you grant us a non-exclusive, worldwide, royalty-free license to use and incorporate them without obligation.

7) Links and Third-Party Content

The Site may link to third-party websites, datasets, tools, or publications. We do not control or endorse third-party content and are not responsible for their availability, accuracy, or practices. Your use of third-party sites is at your own risk and subject to their terms.

8) Pre-sales Information; No Offer, No Guarantee

Any service descriptions, timelines, deliverables, demos, dashboards, case studies, or prices shown on the Site are illustrative and subject to change. Final scope, timeline, IP rights, confidentiality, fees, and payment terms are defined only in a signed Proposal/Statement of Work or Master Services Agreement (collectively, an “Engagement Agreement”). We do not guarantee specific results or outcomes.

9) Portfolio and Attribution

Unless otherwise agreed in an Engagement Agreement, we may reference your organization name and non-sensitive project descriptions in our portfolio and case studies. You may opt out by notifying us in writing; we will honor reasonable confidentiality requests.

10) Open-Source & Third-Party Licenses

Project deliverables may include or rely on open-source or third-party software, libraries, or datasets (e.g., GDAL, rasterio, geopandas, Landsat, Sentinel, NLCD/LCMS, MTBS). Those components are governed by their own licenses and terms, which you agree to follow.

11) Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, OR GOODWILL; OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SITE SHALL NOT EXCEED USD $100.

Nothing in these Terms limits liability that cannot be limited by law.

13) Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; or (c) your infringement or misappropriation of any intellectual-property or other rights.

14) Compliance; Export; Sanctions

You represent that you are not located in, under the control of, or a resident of any country or on any list where access or use would violate applicable U.S. or international export, sanctions, or trade laws. You agree to comply with all such laws.

15) Governing Law; Venue

These Terms are governed by the laws of the State of California, without regard to conflicts of law. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Ventura County, California, for any dispute arising from or relating to these Terms or the Site. You waive any objection to such venue, including forum non conveniens.

16) Termination

We may suspend or terminate access to the Site at any time for any reason. Sections that by their nature should survive (including IP, disclaimers, limitations, and governing law) shall survive termination.

17) Entire Agreement; Severability; Assignment; No Waiver

These Terms constitute the entire agreement between you and us regarding Site use and supersede all prior understandings regarding the Site. If any provision is found unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force. You may not assign or transfer your rights under these Terms without our prior written consent; we may assign them without restriction. Our failure to enforce any right is not a waiver.

18) DMCA Notice (U.S. Only)

If you believe content on the Site infringes your copyright, send a DMCA notice to the contact e-mail with: (a) your contact info and physical/electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and its location; (d) a statement of good-faith belief; and (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act. We may remove content at our discretion and/or notify the user.
